This privacy policy covers the information we collect about you when you use our products or services, or otherwise interact with us, unless an alternate privacy policy is displayed. Apantic, we, our and us, refer to Apantic Limited. We refer to all the products and services we offer collectively as “Services” in this policy.

What information we collect about you

We require certain information to provide our Services to you. We collect this information when you provide it to us, when you use our Services, or when other sources provide it to us, as further described below.

Information you share with us

Account information: We collect information you provide us when you register for an account. This includes contact information (such as your name, email address and phone number), billing information (such as your address), and other information such as a password to log into your account.

Information you provide through our support channels: The Services also include access to our customer support. When you submit a support request, you may choose to submit information regarding a problem you are experiencing with a Service. You will be asked to provide contact information, a summary of the problem you are experiencing, and any other documentation (including screenshots, log files) that would be helpful in resolving the issue.

Information you provide on our Services: You may choose to submit information (including contact details) to our Services, for example to respond to one of our surveys or submit feedback.

Payment information: We use third party payment processors to process payments made to us. We do not retain any financial information (for example, credit card numbers, expiration dates, CVV codes). Rather, all such information is provided directly to our third party payment processors (Stripe and PayPal), whose use of your personal information is governed by their privacy policy, which may be viewed at https://stripe.com/privacy and https://www.paypal.com/webapps/mpp/ua/privacy-full respectively. We collect billing details such as your name, address and email. This may be provided directly by you, or by our third party payment processors.

Additional information we receive about you

We receive certain information about you when you use our Services, from other applications that serve our Services by proxy, and from third parties including advertisers.

Device and connection information: We collect information about your computer, phone, tablet and other services you use to access the Services. Specifically, we collect information such as your operating system, browser type, IP address, referring and exit pages, pages visited, location, device identifiers and crash data. We use your IP address to determine a current location which we use to provide our Services to you. We also collect information about how you use and interact with our Services, (e.g. how much time you spend on which pages, which links you choose to click, etc.).

Cookies: A cookie is a small piece of data that is stored on your computer, mobile or other device you use to access our Services. Like many websites, we use cookies and similar technologies to collect additional website usage data and to operate our Services. You can choose to accept or decline cookies. Most web browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies if you prefer. However, some of our Services may not function properly if you disable cookies. Some of our Services may use Google Analytics which uses cookies to track visitor usage. The software will save a cookie to your computer’s hard drive to track and monitor your engagement and usage of the website, but will not store, save or collect personal information. We use both session and persistent cookies to provide our Services, better understand how you interact with our Services, to monitor aggregate usage patterns, and to personalise or otherwise operate our Services such as providing account security and personalising content. We do not support the Do Not Track browser option.

Other services you link to your account: We receive information about you when you link a third party service with our Services. For example, this information may include contact details such as your name or email address. You should check the privacy settings and policies of these third party services to understand what data may be disclosed to us or shared with our Services.

Other partners: We receive information about you and your activities on and off our Services from third party partners such as advertising partners.

How we use the information we collect

To provide our Services to you: We use information about you to provide our Services to you, including to authenticate you, provide customer support, process your order, prevent fraud and abuse, and to operate and maintain our Services.

For research and development: We are always looking for ways to make our Services smarter, faster, more secure, integrated and useful to you. We analyse how people use our Services and use feedback provided directly to us to identify trends, usage and activity patterns to identify areas of improvement in our Services. We may also test certain new features with some users before rolling out features to all users.

To communicate with you about our Services: We use your contact information to send transactional communications via email or text, if you have provided your phone number. For example, we may send invoices, reminders for subscription expirations, updates to your support requests, technical notices (including security alerts and administrative messages), and downloads of files associated with the Services we provide you. Some of these may have opt outs available, in which case you will find that option either in the communication itself or in your account settings.

To market our Services: We use your contact information and information about how you use our Services to send promotional communications that may be of specific interest to you. These communications are aimed at driving engagement and maximizing what you get out of the Services, including information about new features, survey requests, newsletters and feedback requests. To protect our legitimate business interests: Where required by law or where we believe it is necessary to protect our legal rights and legitimate business interests, we use information about you in connection with legal claims, compliance and regulatory functions, and disclosures in connection with the acquisition, merger or sale of a business. If you are an EEA user, these legitimate business interests do not override your data protection interests, rights and freedoms.

For internal record keeping or to fulfil a legal obligation: Where required by law, we use your information to retain records or fulfil other legal obligations, such as using your contact and billing details to issue VAT invoices.

With your consent: We use information about you where you have given us consent to do so for a specific purpose not listed above.

Information we share and disclose

In the limited circumstances where we disclose your private personal data, we do so subject to your control, because it’s necessary to operate our Services, or because it’s required by law.

Sharing you control: We share or disclose your personal data with your consent or at your direction. For example; you may choose to add someone to a support request, in which case you authorise the disclosure of information within that support request to that additional person, as well as your basic information such as your name and email address.

Service providers: We engage service providers to perform functions and provide services to us. For example, we use a variety of third party services to help operate our services, for example to provide website and application hosting, service development and maintenance, backups, payment processing, analysis (such as Google Analytics) and other services for us. This may require them to access or use information about you. If a service provider needs to access information about you to perform services on our behalf, we may share your private information with them subject to obligations consistent with this privacy policy and other appropriate confidentiality and security measures. We share your information to approved third party payment processors (as detailed above) to process payments; to prevent, detect, and investigate fraud or other prohibited activities; facilitate dispute resolution such as chargebacks or refunds; and for other payment-related purposes.

Compliance with enforcement requests and the law: In exceptional circumstances, we may share information about you with a third party if we believe that sharing is reasonably necessary to: (a) comply with any applicable law, regulation, legal process or governmental request; (b) enforce our agreements, policies and terms of service; (c) protect our legitimate business interests; (d) protect the security or integrity of our products and services; (e) protect Apantic, our customers or the public from harm and illegal activities; or (f) respond to an emergency which we believe in good faith requires us to disclose information to assist in preventing the death or serious bodily injury of any person. However, nothing in this Privacy Policy is intended to limit any legal defenses or objections that you may have to a third party’s, including a government’s, request to disclose your personal data.

Affiliates and change of ownership: In the event that we are involved in a bankruptcy, merger, acquisition, reorganization, or sale of assets, your personal data may be sold or transferred as part of that transaction. This Privacy Policy will apply to your personal data as transferred to the new entity.

Non-personal information: We may share or disclose non-personal data such as aggregated information on interactions across our Services to advertisers.

How we store information we collect

We are committed to ensuring that your information is secure.

Information storage and security: We use data hosting providers in Europe and the United States to host the information we collect, and we use technical measures to secure your data. While we implement safeguards designed to protect your personal information, no security system is impenetrable and due to the inherent nature of the Internet, we cannot guarantee that data, during transmission through the Internet or while stored on our systems or otherwise in our care, is absolutely safe from intrusion by others.

Retention: We retain information as long as it is necessary. We retain account information for as long as your account is active and a reasonable period thereafter in case you decide to re-activate the Services. We also retain some of your information as necessary to comply with our legal obligations, to resolve disputes, to enforce our agreements, to support business operations and to continue to develop and improve our Services. Where we retain information for Service improvement and development, we take steps to eliminate information that directly identifies you, and we only use the information to uncover collective insights about the use of our Services.

Accessing and controlling your information

You can control the personal data you share with us. You can access or rectify this data at any time. You can also request the deletion or restriction of your information, or request a copy of your information in a structured, electronic format. You have rights to object, restrict or withdraw consent to processing. You can exercise some of these choices by logging into the Services and using settings available within the Services or your account. For some types of requests, you may need to contact us using the information provided below.

Your request may be limited in certain cases: for example, if fulfilling your request would reveal information about another person, or if you ask us to delete information which we are permitted by law or have compelling legitimate interests to keep. If you have unresolved concerns, you may have the right to complain to a data protection authority in the country where you live, where you work or where you feel your rights were infringed.

You can opt out of any marketing purposes by using the opt out buttons provided in marketing communications, by updating your preferences within your account, or by contacting us using the information provided below. Even after you opt out from receiving marketing communications, you will continue to receive transactional communications from us regarding our Services.

Transfer of data

To bring you our Services, we operate globally. We transfer, store and use your data in London, Ireland and the United States. Whenever we transfer your information, we take steps to protect it in accordance with this Privacy Policy.

Children and our services

Our services are not targeted towards children, and you must not use our Services if you are under the age of 13. You must also be old enough to consent to the processing of your personal data in your country.

Additional notes

Third party widgets: Our Services may include links and other widgets that direct you to other websites or services whose privacy practices may differ from ours. These widgets may include social media features, such as Twitter’s “tweet” button. These widgets collect your IP address, what page you are visiting, and may set a cookie to enable the feature to function properly. They are either hosted by a third party, or hosted directly on our Services. Your interaction and use of, and any information you submit to any of those third-party sites is governed by their privacy policies, not this one.

Links to third party sites: The Services may include links that direct you to other websites or services whose privacy practices may differ from ours. If you submit information to any of those third party sites, your information is governed by their privacy policies, not this one. We encourage you to carefully read the privacy policy of any website you visit.

We may revise this Privacy Policy from time to time. The most current version of the policy will govern our processing of our information and will always be available at https://www.apantic.com/privacy. If we make a change to this policy that, in our sole discretion, is material we will notify you via an update to the email address associated with your account, if you have an account with us. If you disagree with any changes to this privacy policy, you will need to stop using the Services and deactivate your accounts as outlined above. By continuing to access or use the Services after those changes become effective, you agree to be bound by the revised Privacy Policy.
